תנאי שימוש אלה ("התנאים") מסדירים את השימוש שלך בשירות Aiyelet ("השירות") המסופק על ידי דניאל מעלם / Lucon Labs ("אנחנו", "שלנו"). השימוש בשירות מהווה הסכמה לתנאים אלה. These Terms of Service ("Terms") govern your use of the Aiyelet service ("Service") provided by Daniel Mualem / Lucon Labs ("we", "our", "us"). By using the Service, you agree to these Terms.

1. תיאור השירות1. Service Description

Aiyelet מספקת עוזרת וואטסאפ מבוססת בינה מלאכותית לעסקים. השירות כולל מענה אוטומטי ללקוחות, קביעת תורים אופציונלית, העברת שיחות לבעלי עסקים, התראות טלגרם, ולוח בקרה לניהול ותצורה. Aiyelet provides an AI-powered WhatsApp assistant for businesses. The Service includes automated customer messaging, optional appointment scheduling, conversation escalation to business owners, Telegram notifications, and an admin dashboard for configuration and monitoring.

2. כשירות2. Eligibility

השירות זמין לעסקים בעלי חשבון WhatsApp Business תקף העומדים במדיניות WhatsApp Business של Meta. עליך להיות בעל סמכות לחייב את העסק בתנאים אלה. The Service is available to businesses that have a valid WhatsApp Business Account and comply with Meta's WhatsApp Business policies. You must have the authority to bind the business to these Terms.

3. חשבון וגישה3. Account and Access

• את/ה אחראי/ת לשמירה על אבטחת פרטי החשבון ומפתחות ה-API שלךYou are responsible for maintaining the security of your account credentials and API keys
• את/ה אחראי/ת לכל פעילות המתרחשת תחת החשבון שלךYou are responsible for all activity that occurs under your account
• עליך להודיע לנו מיידית על כל שימוש לא מורשה בחשבונךYou must promptly notify us of any unauthorized use of your account

4. שימוש מקובל4. Acceptable Use

אתם מסכימים שלא להשתמש בשירות כדי:You agree not to use the Service to:

• לשלוח ספאם, הודעות לא מבוקשות, או הודעות שיווקיות המוניותSend spam, unsolicited messages, or bulk marketing messages
• להפר את מדיניות WhatsApp Business או Commerce של MetaViolate Meta's WhatsApp Business Policy or Commerce Policy
• לשדר תוכן לא חוקי, מזיק או פוגעניTransmit illegal, harmful, or offensive content
• להתחזות לכל אדם או ישותImpersonate any person or entity
• להפריע או לשבש את השירותInterfere with or disrupt the Service
• לאסוף מידע אישי של משתמשי קצה בניגוד לחוקי פרטיות רלוונטייםCollect personal data of end users in violation of applicable privacy laws

5. תוכן שנוצר על ידי AI5. AI-Generated Content

השירות משתמש ב-AI (Google Gemini) לייצור תשובות להודעות לקוחות. למרות שאנו שואפים לדיוק:The Service uses AI (Google Gemini) to generate replies to customer messages. While we strive for accuracy:

• תשובות שנוצרו על ידי AI עלולות מדי פעם להכיל שגיאות או אי-דיוקיםAI-generated responses may occasionally contain errors or inaccuracies
• את/ה אחראי/ת להגדרת הנחיות מערכת מתאימות ולבדיקת התנהגות ה-AIYou are responsible for configuring appropriate system prompts and reviewing AI behavior
• את/ה אחראי/ת לתוכן הנשלח ללקוחותיך דרך השירותYou are responsible for the content sent to your customers through the Service
• תכונת ההסלמה מאפשרת לך להשתלט על שיחות בעת הצורךThe escalation feature allows you to take over conversations when needed

6. אינטגרציית וואטסאפ6. WhatsApp Integration

על ידי חיבור חשבון WhatsApp Business שלך דרך תהליך ה-Embedded Signup שלנו:By connecting your WhatsApp Business Account through our Embedded Signup process:

• את/ה מאשר/ת לנו לשלוח ולקבל הודעות בשם העסק שלךYou authorize us to send and receive messages on behalf of your business
• את/ה מסכים/ה לעמוד בתנאי הפלטפורמה והמדיניות של MetaYou agree to comply with Meta's platform terms and policies
• את/ה מבין/ה שמסירת הודעות תלויה בזמינות WhatsApp Cloud API של MetaYou understand that message delivery depends on Meta's WhatsApp Cloud API availability

7. קביעת תורים7. Scheduling

אם הפעלת קביעת תורים:If you enable appointment scheduling:

• את/ה אחראי/ת לשמירה על זמינות מדויקת בספק לוח הזמנים שלךYou are responsible for maintaining accurate availability in your scheduling provider
• את/ה אחראי/ת לכיבוד תורים שנקבעו דרך השירותYou are responsible for honoring appointments booked through the Service
• אנו לא אחראים לקונפליקטים בלוח הזמנים או תורים שהוחמצוWe are not liable for scheduling conflicts or missed appointments
• תמיכה בספקים: Cal.com, Acuity, Calendly, Square, Google Calendar, או מערכת מובניתSupported providers: Cal.com, Acuity, Calendly, Square, Google Calendar, or built-in system

8. מידע ופרטיות8. Data and Privacy

האיסוף והשימוש שלנו במידע מוסדר על ידי מדיניות הפרטיות שלנו. את/ה אחראי/ת ליידע את הלקוחות שלך שעוזרת AI מטפלת בהודעותיהם ולעמוד בחוקי הגנת מידע רלוונטיים. Our collection and use of data is governed by our Privacy Policy. You are responsible for informing your customers that an AI assistant is handling their messages and for complying with applicable data protection laws.

9. זמינות השירות9. Service Availability

אנו שואפים לשמור על זמינות גבוהה אך לא מבטיחים שירות ללא הפסקות. השירות עלול להיות לא זמין באופן זמני לצורך תחזוקה, עדכונים, או בשל גורמים מחוץ לשליטתנו (כולל תקלות ב-API של Meta או בספק ה-AI). We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (including Meta API outages or AI provider issues).

10. הגבלת אחריות10. Limitation of Liability

במידה המרבית המותרת בחוק, Aiyelet לא תהיה אחראית לכל נזק עקיף, מקרי, מיוחד, תוצאתי, או עונשי, כולל אך לא רק אובדן רווחים, מידע, או הזדמנויות עסקיות הנובעים מהשימוש שלך בשירות. To the maximum extent permitted by law, Aiyelet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Service.

11. סיום11. Termination

אנו רשאים להשהות או לסיים את הגישה שלך לשירות בכל עת בשל הפרת תנאים אלה או מכל סיבה אחרת עם הודעה סבירה. תוכל/י להפסיק להשתמש בשירות בכל עת. עם סיום, המידע שלך יישמר לתקופה סבירה לאפשר ייצוא נתונים, ולאחר מכן יימחק. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may stop using the Service at any time. Upon termination, your data will be retained for a reasonable period to allow data export, after which it will be deleted.

12. שינויים בתנאים12. Changes to Terms

אנו עשויים לעדכן תנאים אלה מעת לעת. המשך השימוש בשירות לאחר שינויים מהווה הסכמה לתנאים המעודכנים. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. דין חל13. Governing Law

תנאים אלה כפופים לחוקי מדינת ישראל. כל סכסוך יידון בבתי המשפט המוסמכים בתל אביב-יפו, ישראל. These Terms are governed by the laws of the State of Israel. Any disputes shall be resolved in the competent courts of Tel Aviv-Jaffa, Israel.
